Authorities allege he attempted to evade arrest, while Garces Perez and his legal team state that unmarked federal vehicles sideswiped his car twice before opening fire.
The latest developments surrounding the incident include:
- Medical Status: Garces Perez remains in federal custody at the South Texas ICE Processing Center in Pearsall with a bullet still lodged near his spine. Medical specialists have recommended surgery to remove the bullet, according to U.S. Rep. Greg Casar, who visited Garces Perez in detention.
- Body Camera Discrepancies: Federal officials confirmed that the ICE agent who fired the shots was not wearing an issued body camera at the time of the incident. However, footage released by the Austin Police Department shows local officers rendering emergency medical aid shortly after arriving at the scene.
- Judicial Intervention: A federal judge in San Antonio has issued an order requiring Garces Perez to appear in court in person on September 30 for a hearing regarding an emergency petition filed by his attorneys to halt his deportation.
